UPSC Previous Year Question | Mains GS2 | 2016

Discuss the essentials of the 69th Constitutional Amendment Act and anomalies, if any, that have led to recent reported conflicts between the elected representatives and the institution of the Lieutenant Governor in the administration of Delhi. Do you think that this will give rise to a new trend in the functioning of the Indian federal politics? (Not more than 200 words)

Answer

Introduction

The 69th Amendment (1991) created the National Capital Territory of Delhi with a Legislative Assembly and a Council of Ministers headed by a Chief Minister. It sought representative government while recognising Delhi's national-capital character.

Constitutional Design And Tensions

Constitutional design and tensions

  • Article 239AA provides an elected Assembly and Council of Ministers to aid and advise the Lieutenant Governor, but excludes public order, police and land from the Assembly's legislative field.
  • The proviso requiring reference to the President where the Lieutenant Governor and ministers differ, and the absence of a fully clarified hierarchy, created scope for competing claims over services, appointments and administrative control.
  • Unlike a full State, Delhi combines democratic accountability with Union supervision, producing institutional friction rather than a simple federal relationship.

Federal Significance

Federal significance

  • Conflicts can be reduced through constitutional conventions, clearly allocated rules of business, cooperative consultation and timely judicial interpretation.
  • The arrangement may encourage demands for greater autonomy in other Union Territories, but Delhi's exceptional security and national functions make wholesale replication unsuitable.
  • It therefore signals negotiated, asymmetric federalism, not a new constitutional tier. Democratic accountability must remain meaningful without weakening national interests.
