Does the Rights of Persons with Disabilities Act, 2016 ensure effective mechanism for empowerment and inclusion of the intended beneficiaries in the society? Discuss. (Answer in 150 words)
Answer
Introduction
The Rights of Persons with Disabilities Act, 2016 shifts India toward a rights-based and inclusive framework, expanding recognised disabilities and institutional duties.
Enabling Features
- It recognises 21 disabilities, provides equality, reasonable accommodation, accessibility and non-discrimination.
- It reserves employment and higher-education seats, protects children’s education, and creates national and State commissioners.
- It supports guardianship safeguards, social security, rehabilitation and special courts for offences.
Implementation Gap
Rights remain uneven because rules, accessibility standards, disability certificates, budgets and trained personnel are inadequate. Private establishments and digital platforms often lack universal design; stigma and weak data obscure intersectional exclusion. Make accessibility enforceable with audits and penalties, fill commissioner vacancies, ensure local support centres, consult organisations of persons with disabilities, and link budgets to measurable participation outcomes.
