UPSC Previous Year Question | Mains GS2 | 2018

Whether National Commission for Scheduled Castes (NCSC) can enforce the implementation of constitutional reservation for the Scheduled Castes in the religious minority institutions? Examine. (10) (150 words)

Answer

Introduction

Article 338 establishes the NCSC to safeguard constitutional and legal protections of Scheduled Castes and to investigate complaints.

Constitutional Scope

  • Article 15(5) enables special provisions for SCs and STs in admissions, including private aided or unaided institutions, except minority institutions under Article 30(1).
  • Article 16(4) reservation in public employment does not automatically bind minority educational institutions.
  • Article 338 powers are investigative and recommendatory: the Commission reports, inquires and advises; it does not itself enforce reservations.

Examination

  • A minority institution enjoys Article 30 protection, subject to reasonable regulation of standards and constitutional limits.
  • NCSC may investigate exclusion, seek information and recommend action where applicable, but cannot override the express Article 15(5) exception.
  • Parliament, courts and competent regulators remain the enforcement channels; constitutional amendment or judicial interpretation would be needed for a different rule.
