Which steps are required for constitutionalization of a commission? Do you think imparting constitutionality to the National Commission for Women would ensure greater gender justice and empowerment in India? Give reasons. (Answer in 250 words)

Answer

Introduction

Constitutionalisation gives a commission a status and safeguards that ordinary legislation may not provide, but constitutional status alone cannot ensure substantive gender justice.

Steps For Constitutionalisation

  1. Identify a compelling constitutional objective and define the commission’s mandate.
  2. Pass a constitutional amendment under Article 368, including ratification by at least half the States where federal provisions are affected.
  3. Specify composition, qualifications, appointment process, tenure and removal safeguards.
  4. Provide independent finances, a separate secretariat and power to recruit staff.
  5. Define investigative, advisory, monitoring and reporting powers, including access to documents and witnesses.
  6. Require annual reports to be laid before Parliament and legislatures with action-taken statements.
  7. Provide coordination mechanisms with courts, police, legal services, State commissions and civil society.

Case For Ncw Constitutional Status

  • It could protect the National Commission for Women from arbitrary restructuring or abolition.
  • Security of tenure and transparent appointments may enhance independence.
  • Stronger investigative and compliance powers could improve monitoring of laws and institutions.
  • Mandatory reporting could make governments answerable for gender outcomes.

Limitations

The existing Commission has primarily recommendatory powers. Constitutional status would not automatically provide enforcement authority, adequate funding, police cooperation or social transformation. Gender justice also depends on fast courts, survivor support, political representation, education, economic opportunity and reform of patriarchal institutions. Excessive constitutional detail may reduce flexibility.

Conclusion

Constitutionalisation may strengthen institutional credibility, but it should accompany functional autonomy, enforceable powers, diverse representation, decentralised outreach and measurable government accountability. It is a useful reform, not a standalone solution.
